Terms of Service

1. Acceptance of Terms

By accessing or using JigFlow at jigflow.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

These Terms constitute a legally binding agreement between you and Hargabyte Software LLC (“we,” “us,” “our,” or “Company”). By creating an account, subscribing to a paid plan, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

You must be at least 18 years old to use JigFlow. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

2. Description of Service

JigFlow is a browser-based software-as-a-service (SaaS) application that enables users to:

  • Create and customize laser engraving product templates using our visual editor
  • Enter customer order details (names, dates, messages, and other personalization data)
  • Generate laser-ready files compatible with popular laser engraving software, including:
    • LightBurn (.lbrn files)
    • xTool Creative Space (.xcs files)
    • Scalable Vector Graphics (.svg files)

The Service may include future integrations with third-party platforms such as Etsy and Shopify.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration and Responsibilities

3.1 Account Creation

To use JigFlow, you must create an account through our authentication provider, Clerk. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

  • Use a strong, unique password for your JigFlow account
  • Not share your account credentials with any third party
  • Notify us immediately at hello@jigflow.com if you suspect unauthorized access
  • Take responsibility for all activities that occur under your account

We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

3.3 Account Usage

You may only create one account per user. You may not create accounts by automated means or under false pretenses. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Pricing

4.1 Plan Tiers

JigFlow offers the following subscription plans:

Free Plan ($0/month)

  • Up to 3 products
  • 1 machine configuration
  • Up to 5 custom fonts
  • 10 file downloads per month

Starter Plan ($10/month)

  • Up to 20 products
  • Unlimited machine configurations
  • Up to 20 custom fonts
  • 100 file downloads per month

Pro Plan ($20/month)

  • Unlimited products
  • Unlimited machine configurations
  • Up to 50 custom fonts
  • Unlimited file downloads

4.2 Plan Changes

You may upgrade or downgrade your subscription plan at any time through your account settings.

  • Upgrades: Take effect immediately. You will be charged the prorated difference for the current billing period.
  • Downgrades: Take effect at the start of your next billing cycle. You retain access to paid features until the end of your current period.

4.3 Usage Limits

Each plan includes specific limits on products, machines, fonts, and monthly downloads. If you exceed your plan's download limit, you will be unable to generate additional files until your limit resets at the start of your next billing cycle or you upgrade.

4.4 Pricing Changes

We reserve the right to change our pricing at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers. You may cancel your subscription if you do not agree with the new pricing.

5. Billing and Payments

5.1 Payment Processor

All payments are processed securely through Polar, our payment provider. By subscribing to a paid plan, you authorize us to charge your selected payment method for the subscription fees and any applicable taxes.

5.2 Billing Cycle

Subscriptions are billed on a recurring monthly basis. You will be charged in advance for each billing period on the anniversary of your subscription start date.

5.3 Payment Methods

You must provide a valid payment method to subscribe to a paid plan. You are responsible for keeping your payment information current. If your payment method expires or is declined, you must update it promptly to avoid service interruption.

5.4 Failed Payments

If a payment fails, we will attempt to process the charge again. If payment continues to fail, your subscription may be downgraded to the Free Plan, and you may lose access to features and content exceeding Free Plan limits.

5.5 Taxes

All fees are exclusive of applicable taxes, duties, or other governmental charges. You are responsible for all applicable taxes related to your use of the Service.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting hello@jigflow.com.

  • Cancellation takes effect at the end of your current billing period
  • You retain access to paid features until the end of that period
  • After cancellation, your account converts to the Free Plan
  • If your usage exceeds Free Plan limits, you will need to remove excess products, fonts, or other content to stay within Free Plan limits; excess content will not be deleted automatically but may become inaccessible until you comply with limits

6.2 Refund Policy

We offer a no-questions-asked 7-day refund policy. If you are not satisfied with your subscription for any reason, contact us at hello@jigflow.com within 7 days of the charge and we will issue a full refund. After 7 days, refunds are not available for partial months or unused subscription time.

6.3 Account Deletion

You may request deletion of your account by contacting hello@jigflow.com. Account deletion is permanent and will result in the removal of all your data, including templates, products, uploaded fonts, and generated files. We are not responsible for any loss of data resulting from account deletion. See our Privacy Policy for data retention details.

7. User Content and Ownership

7.1 Your Content

“User Content” refers to any data, text, images, files, templates, font uploads, or other materials that you create, upload, import, or store using JigFlow. This includes:

  • Product templates you design
  • Customer order data you enter
  • Uploaded custom fonts
  • Generated laser engraving files
  • Any other materials you submit to the Service

7.2 Ownership

You retain full ownership of all User Content. We do not claim any ownership rights in your User Content.

7.3 License Grant to JigFlow

By using the Service, you grant us a limited, non-exclusive, royalty-free license to access, store, and process your User Content solely for the purpose of:

  • Providing and operating the Service
  • Generating the laser engraving files you request
  • Syncing data with third-party integrations (Etsy, Shopify) when you explicitly enable such integrations
  • Performing technical maintenance, backups, and support

This license terminates when you delete your User Content or close your account, except where we are required to retain copies for legal compliance or backup purposes.

7.4 Responsibility for User Content

You are solely responsible for your User Content. You represent and warrant that:

  • You have the right to use and upload any fonts, images, or materials you import into JigFlow
  • Your User Content does not infringe on any third-party intellectual property rights, copyrights, or trademarks
  • Your User Content does not violate any applicable laws or regulations
  • You have obtained any necessary permissions or licenses for content you upload

7.5 Customer Data

You acknowledge that you are a data controller for any customer personal data you enter into JigFlow (names, order details, etc.). You are responsible for complying with all applicable data protection laws regarding your customers' data. We process this data on your behalf as a data processor, solely to provide the Service.

8. Acceptable Use

You agree not to use JigFlow to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Upload malware, viruses, or any other harmful code
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use the Service for any purpose other than its intended use (laser engraving template automation)
  • Scrape, crawl, or use automated means to access the Service without our written consent
  • Resell, redistribute, or sublicense access to the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Circumvent any usage limits, access controls, or security measures
  • Use the Service to send spam or unsolicited communications

We reserve the right to suspend or terminate your account for violations of this section, with or without notice.

9. Intellectual Property

9.1 Our IP

JigFlow, including its visual editor, file generation engine, website design, logos, and all associated software and documentation, is the intellectual property of Hargabyte Software LLC. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it as described herein.

9.2 Trademarks

“JigFlow” and the JigFlow logo are trademarks of Hargabyte Software LLC. You may not use our trademarks without prior written consent, except as reasonably necessary to refer to the Service.

9.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, modify, and incorporate that feedback into the Service without any obligation to you.

10. Third-Party Integrations

10.1 Current Integrations

JigFlow uses third-party services to operate, including Clerk (authentication), Supabase (data storage), Polar (payments), and Cloudflare (hosting). Your use of these services is subject to their respective terms and privacy policies.

10.2 Future Integrations (Etsy, Shopify)

We plan to offer integrations with Etsy and Shopify for order synchronization. When available:

  • You must explicitly authorize each integration
  • You are responsible for complying with the respective platform's terms of service
  • We are not responsible for any actions taken by these third-party platforms
  • Integration availability may change without notice
  • Separate terms may apply to specific integrations

10.3 Third-Party Responsibility

We are not responsible for the availability, accuracy, or reliability of any third-party service. We do not endorse and are not liable for any damage or loss caused by third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • The results obtained from the Service will be accurate or reliable
  • Any defects in the Service will be corrected
  • Generated output files will be compatible with all laser engraving machines or software versions

You use JigFlow at your own risk. You are solely responsible for verifying that generated files are correct and safe before using them with your laser equipment. Improper laser settings can cause fire, injury, or property damage. We are not responsible for any damage resulting from the use of files generated by JigFlow.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HARGABYTE SOFTWARE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, business opportunities, or goodwill
  • Any damages resulting from your use of or inability to use the Service
  • Any damages resulting from unauthorized access to or alteration of your data
  • Any damages resulting from the use of generated files with laser equipment

Our total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hargabyte Software LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Your use of generated files with laser equipment
  • Any claim by your customers related to products you created using JigFlow

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting hello@jigflow.com or through your account settings.

14.2 Termination by Us

We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons for termination may include:

  • Violation of these Terms
  • Non-payment of subscription fees
  • Fraudulent or illegal activity
  • Extended inactivity (12+ months on Free Plan with no login)
  • At our sole discretion for any reason

14.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • You remain liable for any outstanding fees
  • We may delete your User Content after a reasonable period (typically 30 days)
  • Sections 7.2 (Ownership), 9 (IP), 11 (Warranties), 12 (Liability), 13 (Indemnification), 15 (Governing Law), and 16 (Dispute Resolution) survive termination

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

16.1 Informal Resolution

Before filing any formal legal action, you agree to first contact us at hello@jigflow.com and attempt to resolve the dispute informally for at least 30 days.

16.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Washington State or remotely via video conference, at the election of the party initiating the arbitration.

16.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16.4 Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property rights or unauthorized access to the Service.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hargabyte Software LLC regarding the Service and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any term shall only be effective if in writing and signed by an authorized representative of Hargabyte Software LLC.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or power outages, or pandemics.

17.6 Notices

Notices to you may be sent to the email address associated with your account. Notices to us should be sent to hello@jigflow.com.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the “Effective Date” at the top of this page
  • For material changes, we will notify you by email or by placing a prominent notice on our website at least 30 days before the changes take effect
  • Your continued use of JigFlow after the updated Terms take effect constitutes your acceptance of the changes
  • If you do not agree with the changes, you must stop using the Service and cancel your subscription
